These Terms of Use (“Terms”) apply to your use of this Internet site (“Site”). By visiting or using this Site, you accept these Terms. You should review these Terms regularly as they may change from time to time. Continued use of this Site by you will constitute your acceptance of any revisions to these Terms. In the event of a conflict between these Terms and any other agreement between you and People’s Trust Insurance Company (“People’s Trust”), that other agreement shall control.

You accept delivery of the following disclosures that relate to information at this Site.

Foreign Jurisdictions: People’s Trust is licensed to transact homeowners insurance only in Florida. People’s Trust’s products and services are available only for personal residential properties located in Florida. By using this Site, you agree that you are obtaining information about or seeking to insure personal residential property located in Florida.

 

Company Identification: The products and services described on this Site are provided by People’s Trust Insurance Company, a Florida domestic property and casualty insurance company. People’s Trust Insurance Company transacts insurance through its affiliated managing general agency, People’s Trust MGA, LLC (“People’s Trust MGA”). People’s Trust MGA or its authorized representative will be identified as the agent of record on any policy issued by People’s Trust where such an agent is required to be designated. People’s Trust MGA is compensated for its services by People’s Trust and also may charge a policy fee as provided by Florida law.

 

Availability of Products: People’s Trust’s insurance products are available to applicants who meet underwriting and eligibility criteria established by the company. There is no assurance that People’s Trust will issue a policy based on information you provide at the Site. No insurance coverage shall be effective unless and until People’s Trust Insurance Company provides confirmation of acceptance. Due to the nature of windstorm risk, People’s Trust may limit its policies by territory, policy type, or other criteria as it may consider advisable under prudent exposure management practices. 
 

PROHIBITED USES

 

Personal Use Only: You will use the Site only for your personal, noncommercial use unless you and People’s Trust have agreed otherwise in writing.

 

Emails: You may not send email to us that is illegal, obscene, profane, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or contains harmful code, political campaigning, commercial solicitation, chain letters, mass mailings, or violates any applicable law, such as the CANSPAM Act.

You may not use any means of systematic retrieval of data or other content from this Site. You may not obtain, or attempt to obtain, access to any material or information on this Site that is protected by passwords or require login identification through any means not expressly authorized by People’s Trust. You may not use the login information of another person, unless they specifically authorized you to do so. If you are accessing this Site pursuant to authority granted by any other person, you must discontinue access on behalf of that person when such authority terminates or is revoked.

 

False Information: Premium quotes and eligibility for People’s Trust products or services will be determined based, in part, on information you provide. People’s Trust reserves the right to verify the information you provide. Under Florida law, a misrepresentation, omission, concealment of fact, or incorrect statement may prevent recovery under a policy if the misrepresentation, omission, concealment, or statement is fraudulent or is material to the acceptance of the risk or the hazard assumed, or if the true facts had been known, the insurer in good faith would not have issued the policy, would not have issued the policy at the same rate, would not have issued the policy in as large an amount, or would not have provided coverage with respect to the hazard causing the loss.

 

Framing: You may not frame any content, trademark, logo, or other proprietary information (including images, text, page layout, or form) of People’s Trust.

 

Links: You agree to obtain our permission before creating a hyperlink or similar link or connection to this Site.

 

Endorsements: You may not use People’s Trust’s name or trademarks in any way that implies affiliation with, or an endorsement, sponsorship or approval by People’s Trust without express written permission. 
 

SECURITY

 
When you use People’s Trust’s online services, you agree to the following conditions:
 

  • People’s Trust is authorized to act on instructions received under your name, password, quote number or other identifying information without any requirement to question those instructions;
  • People’s Trust is not responsible for any unauthorized access to your personal information that is not directly due to the negligence of People’s Trust;

  • You will notify People’s Trust immediately if you believe anyone else has learned your confidential account information or if you believe authorized access to your People’s Trust account may have occurred;
  • People’s Trust may block or terminate access to this Site without prior notice if we believe your confidential account information is being used by someone other than you, if any unauthorized access to your personal information has occurred or may occur, if you cause a financial loss to People’s Trust, if you make a fraudulent claim with People’s Trust, if People’s Trust determines that you pose an unreasonable risk, or for any other reason. DELEGATED ACCESS

 

If you authorize another person to access this Site on your behalf, we may grant that person access to view and transact in your accounts until you notify us that you have revoked their access. If you grant a General Power of Attorney, we may grant Site access to the attorney-in-fact to view your accounts and conduct transactions on your behalf. If you access this site on behalf of another person, you represent and warrant that the authorization or Power of Attorney is currently in force and authorizes the activity you conduct at this Site.
